DELTA CLOUD GAZER CONTEST
Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN.
ELIGIBILITY: Delta Cloud Gazer Contest
("Contest") is open only to legal
residents of the fifty (50) United States and the District of Columbia
("Territory") who are 18 years of age or older. Void in,
Puerto Rico and all other U.S. territories and possession and where prohibited.
Employees of Delta Air Lines Inc. ("Sponsor"), Wieden + Kennedy, and their
respective parents, subsidiaries, affiliates and advertising and promotion agencies
and their immediate families (parent, child, spouse or sibling and their
respective spouses, regardless of where they reside) and those living in their
same households, whether or not related, are not eligible to play or win. By
participating, participants agree to be bound by these Official Rules and the
decisions of the Sponsor, which are binding and final on matters relating to
this Contest. Sponsor reserves the right in its sole discretion to disqualify
any game play at any time which in Sponsor's opinion does not
comply with these Official Rules. Contest is subject to all applicable
federal, state and local laws.
CONTEST PERIOD: Contest starts at 12:00 p.m. ET. on Thursday, November 6
and ends at 11:59 p.m. ET. on
Friday, November 21, 2014 ("Contest Period").
TO PARTICIPATE: Visit www.deltaunbored.com and follow the directions to submit the registration form and
agree to these Official Rules. You
will be required to sign in through a Facebook, Twitter, or Google+ account to
verify your identity. Establishing a Facebook, Twitter or Google+ account is
free. Once you have verified your
identity, click "Start Gazing" to begin to play the game by clicking on clouds
to accumulate points. Each cloud
type will be worth a specific number of points. If you become inactive for 15 seconds, a
countdown will begin alerting you that your session will end soon. If you
remain inactive for more than: 30 seconds, that game
play will end. At the end of the
game play, your rank will be displayed along with the Contest leaderboard. Game
plays generated by script, macro or other automated means or by any means that
subvert the game play process will be void.
WINNER DETERMINATION: At the conclusion of the Contest Period, the
participant with the highest score, as determined by Sponsor in its sole
discretion, will be deemed the potential winner. In the event of a tie, the participant
from among those tied with the longest game play session will be deemed the
potential winner.
WINNER NOTIFICATION: Potential winner will be notified via email and
required to sign and return an Affidavit of Eligibility, Release of Liability
and a Publicity Release (unless prohibited) within seven (7) days of date of
notification or prize may be forfeited. Failure to respond to the initial
notification or to return such documents within the specified time period or
non-compliance with these Official Rules may result in forfeiture of prize and,
at Sponsor's discretion, prize will be awarded to a runner-up.
PRIZE: Winner will receive a certificate redeemable
for economy travel for one (1) person to anywhere Delta Air Lines flies system
wide. (Maximum Approximate Retail Value ("ARV"): $3,460). Ticket is subject to terms and
conditions specified thereon. Ticket must be used by a year after date of
issue. Air travel will be awarded in the
form of a certificate that may be redeemed for round-trip travel on Delta from
the airport served by Delta closest to the winner's home to the specified
destination. Certificate seat is
limited and may not be available on all flights or in all markets. Certificate is
non-transferable, are not redeemable for cash and are void if sold or
bartered. The sale or barter of
tickets obtained through redemption of Certificate is also prohibited. Any ticket obtained through such sale or
barter are void and will not be honored for
travel. Ticket
may be cancelled or reissued without penalty for a period of 24 hours
after reservation is made. After this cancellation/reissue privilege expires, time
and routing changes are permitted (subject to the availability booking class)
however a $200 fee applies (USD/CAD) for travel within the United States,
between the United States and Canada and for travel between the United
States/Canada and the Caribbean, Mexico and Central America. For travel
outside the United States, Caribbean, Mexico, and the Central America, the
change fee for Delta-marketed flights is typically $300, but can vary based on
location and type of fare change (e.g., a fee of $450 (USD/CAD) will apply for
changes made to First/Business class travel between the US/Canada and
Transatlantic markets). Reference

Certificate does not include the September 11th Security Fee of up to $2.50 which will be imposed on each flight segment in the
passenger's ticketed itinerary and international taxes and fees of up to $349
for an economy ticket. A flight
segment is defined as a takeoff and a landing. Baggage fees
of up to $25 for first checked bag and $100 for second checked bag, depending
on itinerary. Allowances subject to size/weight limits. Taxes and fees are subject to
change. Any taxes, fees, or charges
paid at the time of ticket issuance will be refunded if ticket is not
used. However, once redeemed,
Certificate is void and will have no further value. Certificate travel will not qualify for
SkyMiles mileage.
Stopovers/Upgrades/Waitlisting/Open Returns are not permitted for
tickets booked with Certificate.
Lost, stolen or otherwise destroyed Certificate will not be
replaced. Schedules are subject to
change without notice. Additional
restrictions may apply. It is the responsibility of the passenger to be in
possession of all necessary documentation (e.g., valid passport, visa where
applicable) at the time and place of departure. Delta reserves the right to
deny boarding to any passengers without proper documentation.
Winner is
responsible for obtaining all necessary travel documents, including passports
and visa (as applicable). Travel is subject to availability. No substitutions, cash
equivalents, or transfers of prizes permitted by winner. Sponsor reserves the right to substitute
prize (or portion thereof) with one of comparable or greater value, at its sole
discretion. All federal, state and
local taxes as well as any other costs and expenses associated with prize
acceptance and use not specified herein as being provided are the
responsibility of winner, including, but not limited to luggage fees,
accommodations, meals, and ground transportation. All prize details are at Sponsor's sole
discretion.
PUBLICITY GRANT: By participating, each participant, except where
legally prohibited, grants permission for Sponsor and its designees to use
his/her name, username (if applicable), address (city and state), photograph,
voice and/or likeness (including, but not limited to, profile photo) for
advertising, trade and promotional purposes, in any and all media now known or
hereafter discovered, worldwide in perpetuity, in any manner, without further
notice, review, approval or compensation.
RELEASE OF LIABILITY: Participants, by participating, agree that
Sponsor, Facebook, Inc., Twitter, Wieden + Kennedy, and their respective parent,
subsidiary and affiliate companies and advertising and promotion agencies and
all of their respective officers, directors, employees, representatives and
agents (collectively, "Released Parties") will have no
liability whatsoever for, and shall be defended, indemnified and held harmless
by participants against, any liability, losses or damages of any kind,
including, without limitation, for injury, death, to persons, or property
resulting in whole or in part, directly or indirectly, from acceptance, possession,
misuse or use of the prize (including any travel or activity related thereto)
or participation in this Contest.
GENERAL CONDITIONS: Released Parties (as defined below) are not
responsible for lost, late, incomplete, inaccurate, stolen, misdirected,
undelivered, delayed, garbled or damaged game plays, winning messages or mail;
or for lost, interrupted or unavailable network, server, Internet Service
Provider (ISP), website, or other connections, availability or accessibility or
miscommunications or failed computer, satellite, telephone or cable
transmissions, lines, or technical failure or jumbled, scrambled, delayed, or
misdirected transmissions or computer hardware or software malfunctions,
failures or difficulties, or other errors or difficulties of any kind whether
human, mechanical, electronic, computer, network, typographical, printing or
otherwise relating to or in connection with the Contest, including, without
limitation, errors or difficulties which may occur in connection with the
administration of the Contest, the processing of game plays, the functionality
of the game, the announcement of the prize, or in any Contest-related
materials. Released Parties are also not responsible for any incorrect or
inaccurate information, whether caused by site users, tampering, hacking, or by
any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for
injury or damage to participants' or to any other person's computer related to
or resulting from participating in this Contest or downloading materials from
or use of the website. Persons who
tamper with or abuse any aspect of the Contest or website or who are in
violation of these Official Rules or who act in an un-sportsmanlike or
disruptive manner, as solely determined by Sponsor, will be disqualified and
all associated game plays will be void.
Should any portion of the Contest be unable to run as planned for any
reason, in Sponsor's sole opinion, including, without limitation, if it is
compromised by virus, worms, bugs, non-authorized human intervention or other
causes which, in the opinion of the Sponsor, corrupt or impair the
administration, security, fairness or proper play, Sponsor reserves the right
at its sole discretion to suspend, modify or terminate the Contest and, if
terminated, at Sponsor's discretion, award the prize using all nonsuspect,
eligible scores received up to such time.
In the event of a dispute regarding game plays received from multiple
users having the same Facebook or Twitter account, the authorized subscriber of
the applicable account at the time of game play will be deemed to be the
participant and must comply with these Official Rules. The authorized account
subscriber is the natural person who is assigned the account by the applicable
social media platform. CAUTION:
ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE
OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD
SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND
RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER
REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
GOVERNING LAW AND JURISDICTION: All issues concerning the construction, validity,
interpretation and/or enforceability of these Official Rules or the rights and
obligations of participants and Sponsor in connection with the Contest shall be
governed by and construed in accordance with the laws of the State of Georgia
without giving any effect to any choice of law or conflict of law rules or
provisions that would cause the application of any other state's laws.
Participation in the Contest gives each participant's consent to the sole
jurisdiction of the courts sitting in Fulton County, Georgia.
WINNER'S NAME: For the name of the
winner, available after January 1, 2015, send a self-addressed, stamped
envelope to Delta Cloud Gazer ("Contest"), Dept.639, P.O. Box20706, Atlanta, GA 30320-6001 for receipt by June 1, 2015.
